Although we do tend to attract a bit more attention from the constabulary.

$80 fine for lane splitting her in QLD, while in Europe it’s not only legal, but a part of their traffic management plan to reduce congestion. Government departments produce guidelines on safe filtering techniques.

But don’t get me started….....

Devils Advocate:-

You know the area.
You know it is downhill.
You know the speed limit is 60kmh.
You know you will do more than the speed limit if you do not apply your brake at some point if not more than once.
Yet you do not apply the brake and exceed the speed limit.

You are now the Magistrate. Would you let me off knowing the above.

Add solicitors fees and court costs at the end of the day, whether you get off or not…. Will cost you more.

I say a solicitor because the old adage always rings true. “A person who represents themselves before a court has a fool for a client.”

If you can find somewhere the Vicpol guidelines and protocols (I’m taking a stab that is where Donvale is) for use of Lidar radar enforcement, (if that is what they use in Vic) you may have a chance. NSW has specific guidelines now where hand held radar can be used and downhill grades need to be below a particular gradient, with a clear stopping path of I think 300 meters (don’t hold me to it) otherwise they are not permitted to operate hand helds.

i totally dissagree with you !!. i represented myself after being charged with dangerous driving.. i went to the call over hearing and pleaded not guilty..the charge was then upgraded to wreckless driving with willfull intent , thats the worst driving offence you can get ( apart from killing somebody with a vehicle ).. i then shortly therafter went to court and walked away with my licence still intact (no demerit points ) and no form of fine either !!

Just a short side note….remember those “wipe off 5” ads…..you know, “if he’d been travelling just 5 km slower, the pe(de)strian would have only suffered a bruised leg…”, what if the stupid bitch had stayed on the footpath until the car had passed…..then we wouldn’t even be having this discussion, would we!!!

OR…

what if the driver HAD been watching his speed and only doing 55km/h…..but then hit the stupid bitch AT 55km/h (coz he was watching his speedo!!), that’s a whole new commercial right there!!!

I HATE those stupid ads!!!!

It was the same with the one where the guy picks his brother up from school (65 in a 60 zone i think it was).

At 65 a car pulls out and clips the side of his car making him spin into a pole and kill his brother.

If we break it down. Should he have been going 60 he would of plowed right into the side of the other car rather then it just clipping him which may have made it a worse outcome.

Should he have been doing 85 he would of missed the car entirely and his little bro would still be alive.

also,
as an avid motor cyclist & having raced for 10 years and taught high level track days i know how to stop real well,
so when i see the stupid car add when he hits the pedestrian with his wheels all locked and skidding, wtf is with that?
then they cut to the “wipe off 5”
& what do you know the wheels arent locked (prolly abs) or skidding any more,
i am not that fukn stupid,

So why is it that the ‘Cops’ get blamed for what the Government does. Cops don’t have anything to do with speed cameras, school zone restriction cameras, red light cameras, or the current safety cameras.

Blame the Cops for the mobile and Lidar radar. Blame the Govt for everything else

So guess who just got done by a “safety camera” on the weekend!

3am on the highway where the speed limit changes from 80km to 60km and then back to 80 kms. And you all know already where the camera has ingeniously been placed.

I cruised through at a “extremely unsafe” 80 kmph and have been so pissed off since.

Doing the right thing being a designated driver only to get fkd over by a road i dont hardly drive on so didnt notice the camera nor change in speed limit over a 500m stretch.

it depends, does the sign say 40km/h on School Days and hours?

I don’t know about other states but in Queensland the 40km/h school sign has times where it is 40, otherwise it whatever zone you were in before you entered the school zone, so No you don’t need to drive at 40 at 2am during school holidays, surely this is a fairly simple premise that anyone with even the most basic understanding of reading a street sign would understand….

and when in the school times that the signs says of course it is for your safety, we don’t want you getting scared or feeling unsafe with all the school kids out there deliberately vandalising your car, dinting your duco while they head butt your panels with their soft forehead…

Well, here in good ol’ Victoria, some school zones are 40 km/h all day every day…..I can take a photograph for you if you need it!!!

I honestly don’t know enough about the school signs in other states just what I have to do in Queensland, but is it a School Zone 40 or just a normal run of the mill 40km/h sign?
Cause if it’s just a normal 40 sign I would imagine there are other factors to make it all the time, but like I said – I have no idea

I believe it’s something they are trialing around this area (maybe other areas also)....some schools are 24 hour 40km/h and some are only during certain periods of the day. They have normal speed signs (but with a 40 on ‘em) and no other signs regarding times etc, whereas the others are quite obviously marked as only during certain hours and they are accompanied by flashing orange lights. I live across the road from a school that is only restricted before and after school but the school up the road is always 40.

The entire time I am driving through the 40 zones I am so busy watching my speed that I’m not sure I would see a kid if they did run out in front of me!!! Counter productive, I reckon!!

This isn’t a question specific to Elimb and I am certainly not having a dig, but to anyone who thinks they have been hard done by from a copper hiding behind bushes or going down a hill….

Q. Have you ever, in your life sped on a flat road by that same amount or more?
Do you think all the times that you get away with speeding don’t count for anything when you get done going down hill?

Not much at all annoys me in this world, but one thing that gets my goat is when people whinge they got caught by a copper hiding behind abush or a bus stop or something like that. If they were speeding it shouldn’t matter one lick of difference is the copper was playing like a funnel web spider or hovering 10 metres over the road wearing a pirate costume, if you are speeding you deserve to pay the fine.

I am not saint, i have had my share of fines when I was younger but after working in the Civil Engineering and Traffic field for the last 10 years I know why roads are posted at the speeds they are, they aren’t just made up by Governments to raise money they are done for your safety.

enough of the holier than thou crap, but if everyone drove like they made getting to home to their family the number one priority there wouldn’t need to be traffic police to fine us

Although, i think getting rid of the 40km limit and making it unrestricted through these zones could have a positive effect in reducing obesity in schools.

Those little fatties will have to move fast with us coming through at 160.

WRONG…..it is a 40 km/h zone 24 hours a day, 7 days a week and every fricken week of the year….no exceptions!!! I know a lot of areas are only 40 km/h at certain times on school days but there are quite a few that are permanent 40km/h…..and that is bullshit!!!

aahhh….I’m enjoying reading all this road congestion shit…....nothing like living in rural WA …...large rural town,only congestion occurs when all the tourists flock here over the summer…..oops, I’ve already said too much. None of yuz would like it here…stay where you are!!!
